Delaware's sports betting program has passed both Houses and received the governor's signature. But the nature of the sports gambling lottery will not be determined until the state Supreme Court decides what wagering options are legal under the Delaware constitution.

Governor Jack Markell has asked the court to render an opinion on whether the state is allowed to offer straight bets on games, or if parlays are the only acceptable form.

Over thirty years ago, an NFL lawsuit led to a state Supreme Court decision that straight bets were based on skill, while parlays are mostly chance. Delaware's lottery amendment requires that any bets accepted be chance-based, so straight game plays were disallowed.

The NFL has once again filed with the court, protesting the sports betting system as illegal under state law. But this time, many supporters think the court will get it right.

"Back then the court's ruling noted that when Jimmy the Greek picked games even up, he was right 75 percent of the time," said Dover Downs CEO Ed Sutor. "But when he picked winners using a point spread, his success rate fell to 50 percent. Well, we believe 50 percent is a chance bet."

Gaming experts have said if Delaware only gets approval for parlays, there would be a sharp but brief revenue boom, but then only a small permanent increase. However, if straight bets are permitted, lottery revenue is expected to see a significant jump.
